Newborn Injury Due To Surgical Error

Lawsuit Against Javon Bea Hospital

On September 28, 2022, WVFK&N attorneys John LaMantia and Soobin Lee filed a medical malpractice claim on behalf of a newborn who suffered an avoidable injury.

The complaint alleges that the child was born on September 9, 2019, at 36 weeks gestation with congenital anomalies including an anorectal malformation (imperforate anus), crossed renal ectopia, sacral agenesis, and a club foot. On September 11, 2019, the child was incorrectly diagnosed with “urogenital sinus and imperforate anus” (cloaca) by the hospital. On September 11, 2019, the hospital incorrectly performed a colostomy on the child. During the procedures, the doctor made the child’s functional stoma too small and narrow, and not ideally positioned to have stool flow out. This resulted from an unknown reversal of the two stomas reversing the upstream and the downstream stomas on the abdomen. Postoperatively, the child had continued difficulty with stool passage due to the surgical error. Postoperatively, the child required daily irrigations of the stoma to allow stool to pass. The child now suffers from incontinence as a result of the negligence.

The lawsuit alleges that the injuries were a result of the negligence of Javon Bea Hospital and its employees in failing to properly place the colostomy.

The action is pending in the Circuit Court for Winnebago County, Illinois.
