Fetal Death Due to Reckless Cutting of the Amniotic Sac by EMT

Lawsuit against Paramedics of the City of Chicago and Chicago Fire Department | July 12, 2023

On July 12, 2023, WVFK&N attorneys John LaMantia and Soobin Lee filed a medical malpractice claim for the mother who lost a child through stillbirth at 22 weeks of gestation.

The complaint alleges that on August 4, 2022, the patient called for emergency assistance for her contraction at 22 weeks of gestation which started that morning. A Chicago Fire Department ambulance arrived and upon examination by their paramedics, the patient was found with her amniotic bag partially delivered with some mild bleeding and minimal pain. Her contractions were 6 to 8 minutes apart. The Chicago Fire Department paramedics recklessly cut the amniotic bag open with a scapula at her residence. Due to the City of Chicago and Chicago Fire Department’s paramedics’ reckless and willful and wanton actions in opening the amniotic sac at 22 weeks of gestation and their failure to transport the patient in a way to prevent placing additional pressure on the prolapsed amniotic sac and drainage of vital amniotic fluid, the patient lost her child through stillbirth.

The action is pending in Cook County, Illinois.
